Exemption Permits for Zimbabwean and Lesotho Nationals

Recent developments in South Africa have delivered encouraging news for Zimbabwean and Lesotho nationals holding Exemption Permits, offering them an opportunity to apply for an extension of their current permits which will then be issued until 29 November 2025. This article details the significant changes, the implications of automatic extensions, the updated application procedures, and the authorized activities permitted under these permits.

Automatic Extensions:
Zimbabwean nationals with Zimbabwe Exemption Permits (ZEPs) granted in 2009, originally scheduled to expire on June 30, 2024, and Lesotho nationals with Lesotho Exemption Permits (LEPs) issued in 2019, initially set to expire on 31 December 2023, can now apply for the extension of their permit until 29 November 2024 which permits will then be issued with the expiry dates being 29 November 2025.

Impact:
Individuals from Zimbabwe and Lesotho affected by these changes will benefit from the extension of their immigration status, alleviating concerns about potential lapses in their permits.

New Application Process:
ZEP and LEP holders seeking to take advantage of the newly announced provisions must apply for a renewed validity period before 29 November 2024. The application process involves utilizing the VFS Global online portal to obtain the respective permits.

Impact:
This streamlined application process is anticipated to lead to faster processing times, providing a more seamless experience for applicants looking to renew their permits.

Permissible Activities under Exemption Permits:
Exemption permit holders are permitted to engage in various activities, including studying, working, seeking employment opportunities, and conducting business in South Africa throughout the validity of their permits.

Ineligibility for Permanent Residence and Status Changes:
During the validity of the Exemption Permit, holders are not eligible to apply for permanent residence or make changes to their immigration status in South Africa.

The Department of Home Affairs introduced Exemption Permits to facilitate temporary entry for asylum seekers from Zimbabwe and Lesotho, allowing them to participate in business, study, or work.

Initially, the ZEP status was set to expire on 31 December 2022, with subsequent extensions leading to the final expiry date set by the court as 30 June 2024. LEPs, introduced in 2019, initially had an expiration date of 31 December 2023.
